I sent a letter to each of the reps. below is one response:

Thank you for your e-mail concerning SB 408 and the case of animal
cruelty that led to the death of Magnum.

I have received several communications like yours, from people angry
that there was no way to find out who actually committed this crime and
impatient that the state legislature has not yet passed a law making the
punishment for such acts a felony.

I have voted in favor of what is called "Scruffy's Law" every time I
have been given the opportunity, and I plan to continue voting for it
until it becomes law. Senator David Haley, the author of the bill, says
he plans to continue introducing the bill until it becomes law or he
leaves the legislature.

During last year's session, the bill never came to the floor of the
Senate for a vote. This year, we expect to be given the chance to vote
on not one, but two, bills. I agree with you that SB 408 is the
superior, as it is based on Senator Haley's work. SB 402 does not call
for prosecution of animal cruelty cases as a felony until the second
incident of animal cruelty by the same criminal, and I don't think that
is wise. We will see what happens. If only SB 402 comes to the floor, I
will, of course, vote for it. It is an improvement over current law.

If you have questions, on this or any other matter, please do not
hesitate to write me again at this address or call my aide, Cathy
Wilheim, at my office in the Capitol, 785/296-7387.

Once again, thank you for writing. Hearing from the public is an
important part of the legislative process. Please continue to let me
hear from you.

Sincerely,

Donald Betts Jr.
Senator, 29th District
